I see the new rule referring to "Target Housing". From what I can tell so far this means any pre 1978 home or building occupied or visited by a child under the age of 6 at least twice during the week with visits being longer than 3 hours by that same child.

Does this mean the new rule doesn't apply to anything outside of that? What if I'm working for a middle aged couple with no kids?

All housing is included.
Target housing is where there is the most chance of lead being a problem.

I will hand out a flyer to all homeowners, the RRP to all people with children living in a 1980 or older home.
I check property records before seeing anyone, this will give you the date of construction.
Not knowing is not a defense.

Older folks will just think its more government bullshit.

I can't find a thing that says that. I just keep seeing "in target housing". I thought it would clear things up for me by reading this thing, instead, I get more confused! :rolleyes5:

I'm really trying to make sense of all of this and get legal behind it so I don't get sued and nobody gets sick.

This is starting to look like an expensive time consuming crock of s**t.
I might look into becoming a contractor in Bangkok.

Jason - just think built prior to 1978 & you have it - the rest was for the opt out provision which for all intensive purposes is DOA

Paul - quit making life harder on yourself - the regulation only applies to pre-1978 housing and as far as I can tell you operate a clean shop.

When I am sanding in someones house, I have a shop vac hooked up. All I need to change for the Target Housing is I need to use a HEPA vac from now on. I hardly ever used full out barriers as I kept the dust and debris down, now I will have to setup the barrier. I always used to use painters tarps, now I need to use plastic. The trash always went out in a can or was carried out by hand - now it all needs to be in either plastic bags or wrapped. The changes are not that drastic - there just something we will have to adjust to and charge accordingly.

On trim and exteriors.

I won't make a big deal out of it, the flyers (which you created) cost 10 cents a piece. Why not?

Target housing is pre 1978, but in the case of the home being in that date I decided to cover my ass.

On a home built in 1978 or newer I would not even bring it up.
Post 1978 homes are a safe harbor from what I understand. You may be shooting yourself in the foot sales wise by the stance you created above.

How do you think that's going to wash out with the jury when someone's kid gets lead poisoning after you remodeled their 1979 rancher?

I haven't been in this industry very long but I've been around it my whole life, long enough to have seen painters handling balls of white lead from the 55 gallon drum they kept back at the shop. I suppose they disposed of them on Dec 31, 1977 :rolleyes3:

Guess this thinking is a double edged sword of sorts. On one hand, you could be losing a sale, and on the other your trying to cover your ass by creating a 2 year spread. The bottom line is all this fear and speculation on all of our parts about this new law, while it may be justified as a legitimate concern...is bullshit.

It all boils down to the same thing in the end regarding laws, lawyers, and money. The more money you have, the better your attorney, the more shit you can get away with.

How far do we go to cover our asses? Demand our existing client base as well as potential new clients to take a blood test to determine if there is a pre-existing condition? I can see it now...

Good evening Mr. & Mrs Customer. Here is my estimate for your project, and the line forms to the left for the mandatory blood test to check you and your entire family for lead poisoning!

Just got a call from a contractor while posting and he asked me about doing 203 K loan jobs so I asked him if he heard of the rule, he had not.

Right now, it's all about education. Most HO's that I talk to think that I'm nuts until they actually check the resources that I list for them. My subs are slowly but surely catching on--my plumber has been in denial, and my main carpenter just signed up for the class. Keep spreading the word guys--it's the only thing that we can do at this point.
