Insurance agent Joe Boler agreed to field our EPA questions.
Joe will cover what he knows and is still learning about lead, mold ect.
I need questions for this 1 hour webinar.
It will be Joe and myself with slides and then questions from the attendees.
Joe Boler will invite some of his customers and other agents to attend also.
We think 3 Wednesdays from now.

How do we protect ourselves from 'pre-existing' conditions? Potential client knows his kids have high levels of lead in their systems. Hires a contractor and gets a lawyer to find any fault with the service that he then uses as a basis for a lawsuit. He may not win, but the cost to defend is ridiculous. Aside from blood testing, which will never fly, can we use a statement, signed, that says the client knows of no pre-existing conditions of lead? Seems like that would throw things out of court in a hurry.

What type(s) of insurance do I need and Why, To protect my workers and company as a result of the EPA RRP rule?
What are the estimated cost of these insurances?

Mike just my .02 on the non-insurance parts
If they have High Lead Levels - they won't be calling us, Social services will be mandating a Lead Inspector & Abatement contractor assuming they want to keep their kids.
As for the second part, an insurance company can not give you the best legal advice - that is something that needs to be worked out with your lawyer. Maybe they have a clause you can run by your lawyer, but I would definitely talk to your lawyer

Quite actually the insurance company and my accountant gives me legal or educational advice that is given to my attorney for us(company) to make a decision..
I went against my attorneys advice and formed my company the way my accountant wanted because her advice was better suited to what my future plans were..
Insurance companies have as many or probably more attorneys on their payroll than most law firms..
I agree your attorney should be included in your final decision but their input and advice should be given as much weight as your attorney if they decide to give you that(legal) advice..

What's the fine print on a pollution policy. What situations am I covered for, and what are the situations that might void my coverage.
What kind of language do insurance companies insert into this policy that I need to be aware of to ensure I don't end up with a problem if and when I have a claim against it?

I'd like to find out if the Insurance Co's
will base their rates on the % of pre 78'
homes we work on.
This would go a long way in deciding whether
we need to avoid all possible contaminated
projects.
If your paying a premium and only do a couple of
RRP jobs a year,than the added premium would be the deal
breaker.
It wouldn't be fair to pass the premium costs
onto the non-lead HO's.
