On October 30, 2009, NAHB voluntarily withdrew our petition because of the dramatic changes EPA has proposed to make to the LRRP Rule. EPA has already proposed the first of two promised revisions to the LRRP Rule, with comments due November 27, 2009. In the settlement, EPA has said it will finalize this proposal no later than April 22, 2010. If NAHB decides to initiate litigation against the LRRP Rule as revised, a new petition would need to be filed within 60 days of publication of the final rule in the Federal Register, in approximately June 2010.

It looks as if NAHB planned a challenge back in 2008, but has withdrawn it until the dust settles from the settlement.

The Residential Lead-Based Paint Hazard Reduction Act of 1992 required EPA, HUD, and OSHA to reduce the incidence of lead-based paint exposure to children in all residential structures built prior to 1978 (over 60 percent of the nation’s existing housing stock). Since 1992, the federal agencies and over a dozen states have issued various regulations related to lead-based paint. However, EPA did not issue a regulation for renovation and remodeling activities until political pressure and litigation spurred the agency to action.
