This was for Asbestos, but could this be happening with Lead down the road?
A federal jury has found a New York environmental services company and three employees guilty of conspiring for nearly 10 years to falsify lab results and air-quality data.

As mentioned in the "RRP Penalty Guideline’s Established (http://blog.sls-construction.com/2010/rrp-penalty-guidelines)" there are 4 levels of enforcement & that last one is Criminal sanctions which is actually handled by the DOJ, not the EPA
Based on what I read & the jury finding them guilty, they definitely deserve the time

I think by next summer when construction activity picks back up as it typically does, the enforcement will start to pick up dramatically..

Unfortunately when I hear a lot of guys say that they don't intend to follow the lead rule I begin to think that it will require several cases like this to force compliance.
These guys did deserve what they got.

I agree, what these guys did was criminal and deliberate.
I think enforcement is going to be very difficult when it comes to the small guys.

It usually is, so they will target some of the big companies first to set an example.
OSHA does this.

I am actually thinking the opposite.. I think they will catch more of the small guys and nab a few of the larger companies so they can get their point across with larger fines..

I'm still very curious to see how the civil liability will affect compliance.
I have no doubt that there are guys out there ripping asbestos out by the handfull, But I am not aware of anyone personally who will touch the stuff.
It's SOP here to call in an abatement firm.

I agree, but how many guys are doing demo/reno without testing for asbestos?
I don't know much about Asbestos, but the class I had last week, the instructor mentioned that all reno's should be tested for de minimus levels, and air monitoring on residential jobs.
On the small guys, I was thinking of guys like this, we know it is happening all over. Look at the video response too.
